SUPREME COURT: SCHOOLS MUST REDUCE FEES FOR ONLINE CLASSES

The COVID-19 epidemic forced schools to close with changes to online classrooms. The Supreme Court on Monday said educational institutions should reduce fees because their running costs are closed with various facilities available on campus.

All educational institutions are shut down due to the Corona epidemic. Therefore all educational institutions reduce their fees. Institutions can charge the students annual fees for the session 2020-21, but they will have to reduce it by 15 percent. The ruling was delivered by the Supreme Court on Monday.

A bench of Justices AM Khanwilkar and Dinesh Maheshwari ordered the educational institutions to charge fees in six installments by 5 August 2021. It has also been said that if a student is unable to deposit the fees on time, then in those circumstances the result of the students of class X and XII cannot be stopped. Schools cannot prevent such students from appearing in the examination.

Recently, the Rajasthan government, under Section 72 of the Disaster Management Act, 2005, directed the state’s 36,000 aided private and 220 aided minority schools to reduce the annual fees by 30 percent. However, the schools challenged this order of the government, considering it against the fundamental right given to schools to do business under Article 19.1.G of the Constitution.

Schools Cannot Charge Fees For Unused Facilities

Justice Khanwilkar said that the appellants (schools) can charge fees for the academic session 2019-¬20 as per the arrangement prescribed under the 2016 law, but educational institutions take into account the facilities not used by the students for the session 2020-21 Keep 15 percent fewer fees.

The SC also directed the schools to not debar any student from attending either online classes or physical classes based on nonpayment of fees, arrears/outstanding fees.
