The Delhi High Court has been urged by three DU graduates, to direct JNU to give them admission in post-graduate courses since the graduation results of these three students were declared by the Delhi University with a delay during the COVID-19 pandemic.
It was claimed by these DU graduates that the varsity was not granting them admission due to a delay in the publication of their graduation results by the Delhi University despite achieving a higher score in the entrance examinations of Jawaharlal Nehru University (JNU).
The JNU’s Counsel while responding to the submissions of the students said that the admission for several courses was still going on and if the seats were available in the relevant courses for which the petitioners had applied in their respective categories, their cases will be heard sympathetically by the university if their qualify on merit for admission in those courses.
On Tuesday, Justice Prateek Jalan accepted in the hearing the statement made by JNU counsel Monika Arora and he said that it was made clear that as the students’ results have been declared, then the clause that stipulated the preference given to those students whose results had been declared will in no way stand in the way of the admission of these DU graduates. But this applied only if the seats were available in the relevant courses and they otherwise qualified on merit.
The three students seeking admission to the M.A. courses have completed their undergraduate degrees from DU in English (Hons.) and Political Science (Hons.).

Represented through advocates Haider Ali and Kawalpreet Kaur, the petitioners said that they took the JNU entrance examination and had achieved a result higher than that required for admission in the first list published by the University.
On March 3, 2020, an e-prospectus had been published by JNU that laid down the selection procedure for admission in detail.
A clause caused grievance among the students. The clause mention that preference would be given to candidates whose results in their qualifying examinations had been declared.
The petitioners claimed that they were not considered for admission even though they qualified on merit for admission in JNU.

It has been contended by the counsel that the preference is given to candidates whose results had been declared would result in the petitioners being rendered ineligible for no actual fault of theirs and the clause was discriminatory in nature.
The petition was disposed of by the High Court noting the statement made by the JNU counsel and that the students’ counsel had said that she did not want to be pressing for further orders.
