Delhi HC on Delhi University’s decision to conduct Open Book Exams has directed the Delhi University to provide an affidavit stating that the students failing to appear for open book exams will be granted another chance to appear for the examination later.
The next hearing will be done on Tuesday I.e, 7th July. Delhi HC has asked DU to submit a set of guidelines by tomorrow evening to evaluate whether the OBE exams should be conducted or not. Also, the Delhi HC has asked Delhi University’s Dean Examination, UGC’s senior personals, and HRD’s senior personals to be present at the time of hearing through video conferencing.
The jurisdiction bench comprising of Judge Subramonium Prasad and Judge Hima Kohli have further asked University to clarify whether the final year undergraduate students will be given provisional admission to postgraduate programs subject to them clearing the qualifying examinations after the proclamation of their undergraduate results.
The ruling came after the petition filed by the DU students of law Diksha Singh and Prateek Sharma. The petition was filed to obtain guidance to be issued to the Central Government that the DU OBE exams will be conducted after assuring that the students have received adequate and detailed educational instructions.

The petition further claimed that Delhi University has not adopted adequate steps to contemplate the needs of the specially-abled and visually impaired students studying in Delhi University.
On 6th July 2020 I.e., today the Delhi HC proposed a series of questions against Delhi University council and the officials. The Delhi HC claimed that a resentment application was taken away by the petitioner stating that the Delhi University suppressed substantial information from the Delhi HC during the last hearing of the case.
According to the contempt application by the petitioners, the Delhi University in the affidavit present to the court did not mention the commencement of mock tests between 4th to 8th July. Also, the affidavit did not include the postponement of the initial date of the commencement of exams to 10th July.

In response to the contempt application, the senior advocate appealing from the side of the University of Delhi relinquished that they were not aware of the information pertaining to the upcoming OBE exams.
Thereafter, the Delhi HC raised distinctive questions regarding the University’s obscurities in the affidavit. The court further questioned the certain problems the students with disabilities may face during the OBE.
The Delhi HC questioned how is University expecting visually impaired students to fill the captcha code during the OBE exams. The court asked Delhi University that how is University confident that 95% of students will not face any problem during the exams while the students themselves stated that they were not aware of the University’s plan to conduct OBE when they filled their examination forms.
The advocate professional Kapil Sibal appealing from the Petitioners side suggested that Delhi University should postpone the examinations to save the interests of the students.

The advocate Sibal further asked that the University must give provisional admission to PG courses to the students failing to appear for OBE exams. He further questioned Delhi University that why the students who left their hostels and PG’s with no study materials should suffer the loss due to pandemic.
During the hearing, the court was ensured by the University that just like the promotion from one-semester exam to another is concerned the same criteria will be formulated to insist students sit for OBE examinations.
