On Sunday, Advocate Alakh Alok Srivastava took to Twitter to share a letter by a 17-year-old JEE aspirant. The student has written the letter to the Honorable Chief Justice of India, Supreme Court. He has prayed to the CJI to postpone the NEET-JEE exams in view of the COVID pandemic and the flood crisis in the country.

He has been taken under the assistance of Alakh Alok Srivastava since the aspirant is a minor. Advocate Alok will be submitting his letter to the Honorable CJI on his request.

The Bangalore citizen has requested the CJI to show some kindness towards the plight of the lakhs of NEET-JEE aspirants and their family members. The aspirant will be appearing in the JEE Mains exam in September 2020.

The student has brought the attention of the CJI to the coronavirus pandemic and the floods that have ravaged multiple states in the country. States like Madhya Pradesh, Bihar, Assam, North-eastern states, Odisha, Gujarat, etc have been facing incessant floods. These floods have killed more than hundreds of people and have badly affected more than 100 districts of India.

The coronavirus crisis has been worsening each and every day. In the last 24 hours, there has been an addition of 78000 cases to the total COVID-positive tally. The virus has infected crores and has killed lakhs of people all over the world.

The hilly areas of Himachal Pradesh and Uttarakhand have been facing deadly landslides. The persistent coronavirus crisis coupled with the floods has made it completely impossible for students to leave their houses. However, the NTA is adamant about conducting the JEE Mains exam between September 1 and 6.

The student said that the NTA is patently violating the “Right to Health” of lakhs of young students. The “Right to Health” is included in the Right to Article under Article 21 of the Constitution. By conducting the exams in such disturbing times, the NTA is putting the lives of lakhs of students in danger.

The students who are living in flooded areas are the worst sufferers since they do not have any accommodation, safe transportation, and study materials. The Specially-abled aspirants are also the worst sufferers sine they rely on physical touch even for walking or doing their basic day-to-day activities.

The student has also mentioned in his article that the NCHM-JEE exam was conducted by the NTA on August 29and there were no social distancing, SOPs followed. Every district of India has should have had at least one examination center, but that is not the case. There are students whose examination center is at least 1000 km away from their residence. These students will not be able to appear in the exam since many of them do not have any transport facility and rely on public transport.

The COVID-19 virus has been found to be airborne and asymptomatic in many cases. Therefore, the possibility of students getting affected at the examination center and then infecting their family members is very high.

Complete lockdown is still being imposed by many municipal bodies/districts in their respective areas. Several containment zones are there in many big cities. In such areas, the free movement of the students is restricted, and therefore, this will cause a lot of harassment to students.

Because of the upcoming exams, it has been reported that many students have been going through anxiety and depression, huge mental stress, and a few students have also committed suicide.

All the students will be required to wear face masks for more than 5-6 hours and therefore, there will be a reduced oxygen supply to their brains. This will reduce the functioning of their brain, read the letter.

The letter also said that many state governments have come forward and said that they will not be able to implement the SOPs if the exams are conducted on the said dates. Review petitions have been filed by the state governments of Jharkhand, West Bengal, Chhattisgarh, and Maharashtra.

The student has appealed to the CJI to postpone the exam for at least one and a half to two months so that the students will be able to appear for exams safely.
